And in addition , Gaza is not a member nation of the UN , and is not a signatory to the Convention on the Prevention and Punishment of the Crime of Genocide . And so therefore the Hamas led government cannot be charged with genocide . These and other points were made in this video I just began watching .

I'm not saying Israel hasn't committed genocide, it's hard to make heads or tails about anything with so much misinformation regarding this war, but I think it's ridiculous to think Hamas wouldn't murder every Jewish man, woman, and child if they could get away with it. Extending Oct 7 across the entire country isn't a very difficult leap to imagine.

Israel hasn't committed genocide. That's one thing we can be certain of. However that doesn't mean that the Israeli armed forces are not committing genocide. However these whole proceedings should be treated with total and utter contempt.

A preliminary ruling on the matter is coming in as we speak. In this stage they've only asserted that the charges are plausible (the charges have not been thrown out), that the court has jurisdiction (it now has) and that the Palestinians are a protected group under the genocide convention.

International Court of Justice orders Israel to prevent genocide in Gaza

Judge Donoghue says the court has decided that Israel must “take all measures within its its power” to prevent all acts within the scope of the genocide convention.

She adds that Israel must ensure “with immediate effect” that its forces do not commit any of the act in the genocide convention.

Israel must also take immediate measures to improve the humanitarian situation in Gaza.

The ICJ can decide any preliminary measures it deems appropriate to enforce the Genocide Convention while an accusation is in trial.

Yet it did not decide to order Israel to stop the war and leave Gaza, which was South Africa's goal. Why?

Why not a ceasefire?

Because it would have had to go to the Security Council, and the US would have vetoed it. This would have dented the credibility of the Court.

But there is nothing to stop countries from taking what measures they see fit to put pressure on Israel to call a ceasefire.

The ICJ did not care about possible vetoes when it ruled against the US in Nicaragua v United States. Why would it do it now? This would have only diminished US credibility.

It seems you're angry, because the very main goal of the proceeding did not materialize.

And mind you, some judges decided to be soft on South Africa (as it can be inferred from Georg Nolte's statement).

Yes, but what about AFTER this ceasefire?

What could *other nations* do to correct the historic injustice that the Palestinians suffered when they were ethnic-cleansed out of existence in 1948 by powerful economic actors (mafia)?

Is setter-colonialism salvageable here in the Levant? Will the ruins of the Roman Empire (which includes its settler-colonial creations like the USA) continue to "create countries out of crusades" in this region in the future?
